These terms govern your use of the BHISOUTH website and the services it describes. BHISOUTH is the official online home of Ambition Brew Co, LLC, a craft brewery and taproom based in West Jordan, Utah. By accessing this website, you agree to be bound by the terms below.

1. Acceptance of These Terms

By accessing, browsing, or using the BHISOUTH website, you agree to these terms of service, together with our privacy policy, which is incorporated by reference. These terms form a binding agreement between you and AMBITION BREW CO, LLC.

If you are using the website on behalf of a company, organization, or other legal entity, you represent that you have authority to bind that entity to these terms. In that case, references to you throughout these terms extend to that entity.

We may update these terms periodically as described in section 17. Your continued use of the website after changes are posted means you accept the revised terms. If you do not accept the terms or any future revision, please stop using the website and its services.

2. Eligibility and Age

Our taproom serves alcoholic beverages, and the services described on this website are intended for adults of legal drinking age. To use the services that involve the purchase or consumption of alcohol, you must be at least twenty-one years of age in the United States.

By placing an order, joining the brew club, or attending an event, you represent that you are of legal drinking age. We may ask for identification at any time, both in person and online, and we may decline service if we believe a customer is below the legal age or if we cannot verify their age.

We reserve the right to refuse service to anyone for any lawful reason. We ask that you drink responsibly and never drive after drinking. Our team has the right to cut off a customer who appears intoxicated, and we exercise that right without hesitation because the safety of our guests and our community matters more than any sale.

3. Use of the Website

You may use the BHISOUTH website for lawful purposes only. You agree not to misuse the site in any way. This includes not attempting to gain unauthorized access to our systems, not interfering with the site availability, and not collecting information about other visitors without their knowledge.

You may not use automated tools, robots, or scrapers to extract content or data from the website in bulk. You may not reproduce, duplicate, copy, or resell any part of the website or content without our prior written permission.

We work to keep the website accurate and available, but we do not guarantee that it will be error-free or uninterrupted. Access to the website may be suspended from time to time for maintenance, repairs, or reasons beyond our control.

4. Brew Club Accounts and Memberships

Our brew club is a membership program that entitles members to certain benefits, including early release notice, bottled beer access, and discounts at the taproom. Membership is offered by yearly subscription and is limited to a set number of members.

To become a member you must provide accurate information, including your name, email, and a valid payment method. You are responsible for keeping your membership information current and for making sure payment details are valid. You are responsible for all activity that occurs under your membership.

Membership benefits may change from time to time as we develop the program. We will notify members of any significant changes. We reserve the right to suspend or cancel a membership if the terms are breached or if we have a reasonable basis to do so.

5. Payments and Fees

All prices for products and services are displayed in United States dollars. Prices may change at any time, but any price change will not affect orders already confirmed.

Membership fees and product purchases are processed securely through our payment providers. You agree to pay all charges associated with your account at the prices in effect when the charge is made. We do not store full payment card numbers on our own systems; card data is handled by our certified payment processor.

Taxes are calculated and added where required by law. If a charge appears on your statement that you believe is incorrect, please contact us at helpdesk@bhisouth.buzz within a reasonable time, and we will help resolve the issue.

6. Cancellation and Refunds

Brew club memberships renew on a yearly basis unless you cancel before the renewal date. You may cancel your membership at any time by contacting us at helpdesk@bhisouth.buzz or by calling +19804671638. Cancellation will take effect at the end of the current billing period.

We want you to be happy with your beer. If you are not satisfied with a product purchased from the taproom, please let us know and we will work with you to make it right, subject to applicable law and our alcohol service obligations.

Deposits for private events and catering may be required and are generally non-refundable unless the event is cancelled by us. We will always try to reschedule rather than keep a deposit. Refund policies are spelled out in each event agreement.

7. Growler and Container Rules

We offer growler and crowler fills from our station. To protect the quality of the beer and the safety of the glass, we ask that containers be clean, empty, and in good condition before a fill.

We reserve the right to refuse a fill to any container we consider damaged, dirty, or unsuitable. Our staff will inspect each container before filling and purge it with gas to keep oxygen away from the beer.

When you bring a container from home, you accept responsibility for its condition and for transporting the filled beer safely. Please consume fresh beer promptly and keep it cold, as we cannot be responsible for how the product is handled after it leaves our taproom.

8. Private Events and Catering

Our back room is available for private events such as birthdays, reunions, and business gatherings. Booking is confirmed by a signed agreement and a deposit. The agreement will set out the date, guest count, beer selection, and any catering details.

You agree to conduct your event in a way that respects our space, our staff, and our neighbors. We may ask guests to leave if they behave in a way that is unsafe, disruptive, or unlawful. We reserve the right to cancel an event at any time, with a refund of any deposit, if necessary to comply with law or protect our team.

For catering, we work with local kitchens to provide food that pairs with our beer. We cannot guarantee against allergens in food prepared by third-party kitchens, so please notify us of any allergy concerns, and we will pass them along.

9. Responsible Alcohol Policy

Alcohol can be harmful if misused, and we are committed to serving responsibly. We will not serve anyone who appears to be or is under the legal drinking age, and we will not serve anyone who appears intoxicated.

We encourage every guest to pace their consumption, to eat, and to arrange a safe ride home. We gladly offer water and non-alcoholic options. Our staff is trained to recognize intoxication and to respond calmly and respectfully.

By using our services, you agree to drink responsibly and to comply with all applicable alcohol laws. You are responsible for your own conduct regarding the consumption of alcohol, and you agree to hold us harmless from harm caused by your own misuse of alcohol.

10. Intellectual Property

All content on the BHISOUTH website, including text, graphics, logos, product names, illustrations, and the overall design, is owned by or licensed to AMBITION BREW CO, LLC and is protected by copyright, trademark, and other intellectual property laws.

You may view and download material for your personal, non-commercial use. You may not modify, reproduce, distribute, display, or create derivative works from the content without our prior written permission. All trademarks, service marks, and trade names used on the site belong to their respective owners.

Nothing in these terms grants you any right to use our trademarks, logos, or trade dress. The name AMBITION BREW CO, LLC and the BHISOUTH branding are valuable assets, and we protect them accordingly.

11. User Submissions

When you send us a message, a review, a photograph, or any other content, you grant us a limited, worldwide, non-exclusive license to use that content to provide and improve our services, including displaying it on our website and social media if we choose.

You represent that you own or have the right to provide any content you submit, and that it does not infringe the rights of any third party. You agree not to submit content that is unlawful, obscene, defamatory, or harmful.

We are not obligated to post or use any submission. We reserve the right to remove any content that we consider, in our reasonable judgment, to violate these terms or applicable law.

The website and its content are provided on an as is basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the website will be uninterrupted, timely, secure, or free of errors or viruses. We do not warrant the accuracy, reliability, or completeness of any content or information available through the site, including descriptions of beer, events, or hours.

Information about the alcohol content and character of our beers is provided in good faith but may vary slightly by batch. You should rely on your own judgement and consult a professional where appropriate. Nothing on the site is intended as medical, legal, or professional advice.

13. Limitation of Liability

To the maximum extent permitted by law, AMBITION BREW CO, LLC and its staff will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the website or services.

Our total liability for all claims arising under or in connection with these terms, whether in contract, tort, or otherwise, will not exceed the greater of the amount you paid us in the twelve months before the claim or one hundred dollars.

Nothing in these terms limits liability that cannot be limited by law, such as liability for death or personal injury caused by negligence, or for fraud. Some jurisdictions do not allow certain exclusions, so some of the limits above may not apply to you.

14. Indemnification

You agree to indemnify, defend, and hold harmless AMBITION BREW CO, LLC, its officers, employees, and agents from and against any claims, damages, losses, liabilities, and expenses, including reasonable legal fees, arising out of or related to your use of the website, your breach of these terms, or your violation of any law or the rights of a third party.

We will notify you promptly of any such claim and, subject to our right to control our own defense where we reasonably elect to do so, allow you to participate in the defense. You will cooperate with our reasonable requests in defending any claim.

This indemnity provision survives the termination of these terms and continues to protect us after your relationship with the brewery has ended.

15. Governing Law and Disputes

These terms are governed by the laws of the State of Utah, United States, without regard to its conflict of law principles. The courts of the State of Utah will have exclusive jurisdiction over any dispute arising under these terms, and you consent to the personal jurisdiction of those courts.

Before filing any claim, you agree to make a good faith effort to resolve the dispute by contacting us at helpdesk@bhisouth.buzz. We will make a similar effort on our side. If we cannot resolve the matter informally within thirty days, either of us may pursue formal remedies.

If you live in a jurisdiction where certain provisions of this section are not lawful, those provisions will be enforced to the extent permitted by that jurisdiction, and the remainder of these terms will remain in effect. Nothing here prevents you from lodging a complaint with an applicable regulator.

16. Termination

We may suspend or terminate your access to the website or services, in whole or in part, at any time and for any reason, including a violation of these terms. We will give you reasonable notice where practical, unless we are required to act immediately to protect our systems or comply with law.

Upon termination, the terms that by their nature should survive will continue, including sections covering disclaimers, limitation of liability, indemnification, governing law, and intellectual property.

You may stop using the website at any time, and you may cancel any membership as described. Termination of access does not release you from obligations that arose before the termination.
